By accessing or using fAIry products and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

fAIry provides an AI-powered interactive storytelling platform consisting of:

  • The fAIry Board hardware device
  • Collectible figurines and story world accessories
  • Mobile companion app for parents
  • Cloud-based content and synchronization services

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service.

4. Parental Responsibilities

The Service is designed for use by children under parental supervision. As a parent or guardian, you agree to:

  • Supervise your child's use of the Service as appropriate for their age
  • Review and manage content settings through the parent app
  • Ensure the device is used in accordance with these Terms

5. Purchases and Refunds

Hardware Products

Physical products (fAIry Board, figurines, accessories) are covered by our 30-day return policy. Items must be in original condition with packaging.

Digital Content

Digital story packs and content are non-refundable once downloaded or activated.

Subscriptions

If applicable, subscription services may be canceled at any time. Refunds are provided on a pro-rata basis for the unused portion of the billing period.

6. Content and Conduct

When using custom content creation features, you agree not to:

  • Upload inappropriate, offensive, or harmful content
  • Create content that infringes on intellectual property rights
  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer or modify the Service

We reserve the right to remove content that violates these Terms.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by fAIry, Inc. and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any custom content you create (such as custom figurines or stories), but grant us a license to use this content to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, fAIRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

11. Termination

We may suspend or terminate your access to the Service for violation of these Terms or for any other reason at our discretion.
